  3. Educational and Application Information: Academic history, transcripts, diplomas/certificates, language test results, and details about the programs/colleges or universities you are applying to.

  4. Consultation Details: Any additional personal information you provide during consultations or communications with us (for example, information gathered after an initial consultation that may not be collected through the website forms). This can include documents required by colleges/universities or agents as part of the application (such as identification or proof of citizenship for international students). We collect this information only as necessary to provide our services to you. In many cases, initial contact information is collected via our website or inquiry forms, and further detailed information is gathered through follow-up consultations (e.g. by phone or email) after the initial consultation, rather than through the website directly.


How We Use Your Information

We use your personal information only for the purposes for which it was collected, primarily to assist you in applying to colleges or universities in Canada and to deliver related services. Specifically, we may use your information to:

  1. Process Applications: Complete and submit college or university application forms on your behalf, including providing required personal and academic information to the chosen institutions.

  2. Facilitate Communication: Contact you with updates or queries regarding your applications or our services, and to communicate with colleges, universities, or authorized agents about your application status.

  3. Service Delivery: Share necessary details with partner colleges, universities, application platforms, or accredited college/university agents involved in the admissions process, in order to facilitate admissions decisions and enrollment (only as part of the application process you have requested).

  4. Compliance and Operations: Ensure compliance with legal or institutional requirements (such as verifying eligibility or identity if required by an institution) and to maintain our business operations (for example, keeping records of applications submitted).

We will not use your personal information for any additional purposes (such as marketing or advertising) without your consent. We do not sell, rent, or trade your personal data to third parties for their own marketing or any unrelated purposes. If we ever wish to use your information for a new purpose, we will obtain your consent before doing so.


Disclosure of Personal Information

We may need to disclose (share) your personal information to third parties, but only in the limited circumstances described below:

  1. Colleges and Universities: We share your information with the colleges, universities, or other educational institutions to which you choose to apply. This includes sharing data on application forms, academic records, and any supporting documents required by those institutions as part of the admissions process. These institutions will use your information to evaluate and process your application and will handle your data according to their own privacy policies.

  2. Authorized Agents and Partners: In some cases, we work with college or university application partners and authorized agents who assist in the application or recruitment process. We share relevant personal information with these partners strictly for the purpose of completing or facilitating your application. Any such partners are expected to protect your information and use it only for the application process you have initiated.

  3. Service Providers: We may disclose your information to trusted third-party service providers that help us operate our website or provide our services (for example, cloud storage providers, IT support, or email service providers). These service providers will only access and use your information on our behalf and under our instructions, and they are contractually obligated to safeguard your data and keep it confidential.

  4. Legal Requirements and Protection: We may disclose personal information if required by law or legal process (for example, in response to a court order or government request), or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with a law. In any situation where disclosure is required by law or for safety/legal reasons, we will only disclose what is necessary and will, if lawful, inform you of such disclosure. Aside from the situations above, we will not disclose your personal information to any third party without your consent, unless such disclosure is otherwise permitted or required by law. We do not share your personal information with any third parties for purposes unrelated to your application. You can be assured that all sharing of data is done solely to fulfill the service you have requested (your college/university applications) and for no other purpose.


Data Retention and Deletion

We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, after which it is securely deleted. In practice, this means: once your college or university applications have been completed and submitted, and we have received confirmation that the relevant institution or authority has received and processed your information (for example, an application approval or an admission decision), we will delete or anonymize the personal data you provided for that application. We do not keep your personal information indefinitely or beyond what is needed. If you decide not to proceed with our services or an application, or if you withdraw your application, we will delete the personal information related to those activities, unless we are

required by law to retain it for a certain period.

We may retain minimal information (such as your name and contact details and a record that you used our service) for legitimate business purposes such as maintaining financial records, proof of consent, resolving disputes, or complying with legal obligations. Any such information is held in accordance with this Privacy Policy and applicable laws. By adhering to the principle of limiting retention, we ensure that we only retain personal information as long as necessary for the fulfillment of the identified purposes. After that, we securely destroy or erase the data. If you wish to have your information deleted sooner (for example, after your application is done) please see the section Your Rights and Choices below for how to request deletion.


Data Security

We take the security of your personal information seriously. We have implemented appropriate physical, technical, and administrative security measures to protect your personal data from unauthorized access, disclosure, alteration, or destruction. These measures include access controls to our systems and files, encryption and secure connections where applicable, and employee confidentiality agreements to ensure your data is handled with care. The sensitivity of the personal information you provide (such as your date of birth or academic records) is taken into account, and we apply security safeguards appropriate to that sensitivity. While we strive to protect your information, please note that no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, we cannot guarantee absolute security of information. You share and submit personal information at your own risk, but we will always do our best to protect it. If we become aware of a data breach or security incident that affects your personal information, we will notify you and the appropriate authorities as required by law.


Cookies and Tracking Technologies

Our website does not currently use cookies or similar tracking technologies to collect personal information about your browsing behavior. We do not use third-party analytics tools (such as Google Analytics) or tracking scripts on our site at this time. This means we are not automatically collecting data such as your IP address, browser type, or browsing patterns for analytics or marketing purposes through cookies. If in the future we decide to implement cookies or analytics tools to improve our services or website functionality, we will update this Privacy Policy accordingly and ensure that any use of cookies will be disclosed to you. We will also obtain any necessary consents required by law (for example, providing a cookie notice or opt-in, if required) before deploying such technologies. For now, you can use our site without concern that your personal data is being tracked for analytics or advertising purposes.


Your Rights and Choices

For example, if you initially agree but later do not want us to continue processing your data or sharing it with an institution, you can contact us to withdraw consent. Note: Withdrawing consent may affect our ability to continue providing you with certain services (e.g. if you withdraw consent during an application process, we might not be able to complete the application on your behalf). We will inform you of any implications of withdrawing consent.

  2. Access to Your Information: You have the right to request access to the personal information we hold about you. This means you can ask us to confirm whether we are processing your personal data and request a copy of that data. We will provide you with access to your information, within a reasonable time and at minimal or no cost, as required by law. There are some exceptions in the law where we might not be able to provide certain information (for example, if it involves personal information of other individuals or legal privilege), but we will inform you if any such exception applies.

  3. Correction/Accuracy: If any of your personal information is inaccurate or incomplete, you have the right to request that we correct or update it. We rely on you to provide accurate information and to inform us of any changes (such as a new email address or an updated academic record). We will promptly correct any inaccuracies in your personal data when notified or discovered.

  4. Deletion of Information: As described in the Data Retention section, we generally delete? your personal information once it is no longer needed for the purpose it was collected. In addition, you have the right to request deletion (erasure) of your personal information from our records once the purpose of collection has been fulfilled. We will honor such requests and delete your data, provided we do not have a legal obligation to retain it. If we must keep certain information for legal or legitimate business reasons, we will inform you.

  5. Challenging Compliance: If you have concerns or complaints about how we handle your personal information, you have the right to challenge our compliance with applicable privacy laws. You may contact us (see Contact Us below) to discuss any issues. We will investigate and respond to any complaint or concern you raise. If you are not satisfied with our response, you also have the right to file a complaint with the Office of the Privacy Commissioner of Canada or the relevant provincial privacy commissioner in your jurisdiction. We will provide you with the contact information for the appropriate privacy commissioner upon request.

International Users and Data Transfers

Applycap.ca is based in Ontario, Canada, but our services are available to international students around the world. If you are accessing our site or using our services from outside Canada, please be aware that your personal information will be transferred to and processed in Canada (and potentially in other jurisdictions, as needed to complete your college applications). By providing your information and using our services, you consent to the transfer of your personal information to Canada and acknowledge that it will be subject to Canadian privacy standards and laws. We handle all personal information according to this Privacy Policy and PIPEDA’s requirements, regardless of where you are located or where the data is processed. In some cases, we may also transfer your information to colleges, universities, or agents located in other countries (for example, if an application partner or agent is based outside Canada, or if you are applying to a Canadian institution through an overseas representative). When we transfer data across borders, we take steps to ensure appropriate protection. Our third-party service providers (such as cloud storage or email services)

might use servers outside of Canada (for example, in the United States or other countries). In all such cases, we remain responsible for protecting your personal information and will ensure that any service providers are required to maintain privacy protections in line with Canadian standards. However, please note that once personal information is in another country, it may be subject to the laws of that country (for instance, it could be accessed by government authorities under foreign laws). Despite these differences in jurisdiction, our commitment is to maintain the privacy and security of your information no matter where it is processed. All businesses operating in Canada that handle personal information crossing national borders are subject to PIPEDA’s requirements, and we adhere to those requirements. Children’s Privacy

Our services are intended for prospective college and university students, who are typically young adults or older teenagers. We do not knowingly collect personal information from children under the age of 13. If you are under 13, please do not use our website or send us any personal information. If we learn that we have inadvertently collected personal information from a child under 13, we will delete that information. For users who are minors but above 13 (for example, 16 or 17 years old high school students planning to apply to college), we strongly recommend that you involve a parent or guardian in the application process. If you are under the age of majority in your home country or province (the age of majority is 18 in Ontario), please ensure that you have permission from a parent or legal guardian to use our services and provide personal information. We may require verification of parental consent for minors using our services, in accordance with applicable laws and guidelines to protect young individuals’ privacy. Changes to this Privacy Policy We may update or modify this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. If we make significant changes, we will post the updated Privacy Policy on our website with a new effective date and, if appropriate, provide a more prominent notice (such as a banner on our site or an email notification). We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your information. Your continued use of our website or services after any changes to this Privacy Policy constitutes your acceptance of the updated terms.
