Acceptance of Terms
By accessing or using the ApplyCap.ca website ("ApplyCap," "we," "our," or "the Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not access or use the Site. These Terms constitute a legally binding agreement between you and ApplyCap.
We reserve the right to amend or update these Terms at any time. Any changes will be effective upon posting on the Site. Your continued use of ApplyCap after changes are posted constitutes acceptance of the revised Terms. You are responsible for reviewing these Terms periodically.

1. Scope of Services and Regulatory Compliance
   ApplyCap provides college and university application support services only. Our services are limited to assisting users with researching educational programs and facilitating applications to Canadian colleges and universities.
   ApplyCap does not provide immigration advice, visa services, or study permit assistance. We do not prepare, submit, or advise on immigration applications, study permits, visas, or any other matter regulated under Canadian immigration law.
   ApplyCap operates in compliance with Canadian laws governing immigration advice, including the Immigration and Refugee Protection Act (IRPA). Where information about immigration, visas, or study permits may appear on the Site, such information is strictly general and informational in nature, and users are responsible for seeking advice from authorized immigration professionals or official government sources.
   
   

2. Eligibility
   By using the Site, you represent and warrant that:
   ● You are of the age of majority in your jurisdiction, or you have obtained the consent of a parent or legal guardian;
   ● You have the legal capacity to enter into a binding agreement; and
   ● All information you provide is accurate, complete, and submitted either on your own behalf or with proper authorization.
   The Site is not intended for children under the age of 13.
   
   

3. Permitted Use
   ApplyCap grants you a limited, non-exclusive, non-transferable, and revocable license to access and use
   the Site solely for personal, non-commercial purposes related to researching and applying to Canadian
   educational institutions.
   Any use of the Site outside this scope is strictly prohibited.
   
   

4. User Obligations and Prohibited Conduct
   You agree not to:
   ● Submit false, misleading, or incomplete information;
   ● Use the Site for unlawful, fraudulent, or deceptive purposes;
   ● Attempt to gain unauthorized access to the Site or its systems;
   ● Copy, scrape, reproduce, or commercially exploit Site content;
   ● Impersonate another individual or misuse accounts;
   ● Upload or transmit abusive, defamatory, or unlawful content.
   We reserve the right to suspend or terminate access for any violation of these Terms.
   
   

5. Privacy and Personal Information
   ApplyCap collects, uses, and protects personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA). Personal information is collected solely for the purpose of facilitating college and university applications and related communications. We do not sell personal information and do not transfer personal data outside of Canada.

6. Intellectual Property
   All content on ApplyCap.ca, including text, graphics, logos, and software, is the property of ApplyCap or its licensors and is protected by applicable intellectual property laws. Unauthorized use is strictly prohibited.
   
   

7. Third-Party Links
   The Site may contain links to third-party websites, including educational institutions or government resources. ApplyCap is not responsible for the content, accuracy, or practices of third-party sites.
   
   

8. Disclaimer of Warranties
   ApplyCap is provided on an "as is" and "as available" basis. We make no warranties or guarantees regarding accuracy, completeness, availability, or outcomes, including admission decisions.
   
   

9. Limitation of Liability
   To the maximum extent permitted by law, ApplyCap shall not be liable for any indirect, incidental, or consequential damages arising from use of the Site or services. Our total liability, if any, shall not exceed CAD $100 or the amount paid to us in the preceding 12 months, whichever is greater.
   
   

10. Indemnification
    You agree to indemnify and hold harmless ApplyCap from any claims arising from your use of the Site, violation of these Terms, or infringement of third-party rights.
    
    

11. Governing Law
    These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved exclusively in the courts of Ontario, Canada.
    
    

12. Termination
    We may suspend or terminate your access at any time for breach of these Terms or for legal or security reasons. Certain provisions will survive termination.
